SAF SUBMITS SCHOOL RESPONSE FOR SUMMARY TRIAL IN W. VIRGINIA GUN CASE

BELLEVUE, WA – The Second Amendment Foundation and its partners in a federal case challenging the federal ban on the sale of firearms to young adults ages 18 to 20, filed a response brief supporting their motion for summary judgment in the US District Court for the Northern District of Western Virginia.

SAF is joined by the West Virginia Citizens Defense League and two private citizens, Benjamin Weekley and Steven Brown. They are represented by attorneys John H. Bryan of Union, W. Va. and Adam Kraut of Westtown, Pa. The case is known as Brown vs. ATF.

“We filed this case in September,” recalled SAF founder and executive vice president Alan M. Gottlieb, “and it’s moving forward, which suggests the issue is ripe. As we explained in the motion, defendants cannot point to a single enumerated constitutional right that does not apply to the age of 18. There is no historical evidence to support an arbitrary ban on the purchase and ownership of firearms for young adults of legal age. than 18. While people in this age group are considered mature enough for military service, service in the armed forces, and in today’s world to be able to vote, run for public office, start businesses, marry, enter into contracts, and enjoy all the protections. established in the Fourth, Fifth and Sixth Amendments. Only their rights under the Second Amendment are affected.”

Kraut, who also serves as SAF’s executive director, notes: “Biden’s Justice Department argues that Congress and the states ‘expressly recognized that those under the age of 21 were generally unemancipated and subject to parental authority. ‘, which is ridiculous. People over the age of 18 have not been considered minors for decades, and they know it. This fact alone leaves them unable to defend the constitutionality of this firearms ban in a manner consistent with the Supreme Court’s directive in last summer’s Bruen decision.”

“It’s been a long time for this issue to be resolved,” Gottlieb added. “Young adults should be allowed to exercise all of their constitutionally enumerated rights, and that’s really what this case is about.”
