DNR Urban Forestry Program Announces 2023 Grant Recipients

MADISON, Wisconsin. – The Wisconsin Department of Natural Resources (DNR) today announced the recipients of the Urban Forestry Grant Program for the 2023 grant year. The program helps fund projects consistent with state and national goals for increase the canopy of urban forests.

The Urban Forestry Grant Program had nearly $700,000 in grant funding, with $419,860 in state funding and an additional $273,512 in federal funding. A dollar-for-dollar matching puts the estimated total cost of these projects at $1.5 million. In total, 58 applications were selected for funding, with awards ranging from $2,106 to $25,000.

Eight additional applicants may also receive funding in a second round in spring 2023 if funds set aside for the Catastrophic Storm Grant Program are not needed during the winter months.

There were two types of grants available for this application cycle, regular and startup. Regular grants award up to $25,000 to support new and innovative projects that will develop sustainable urban and community forestry programs. Starter Grants are streamlined grants available to communities wanting to start or restart an urban forestry program and are competitive cost shares of up to $5,000.

Urban tree canopies provide benefits such as local heat mitigation, removal of air, water, and soil pollutants, and improved mental health. The urban forest encompasses trees on both public and private property. Priorities for the 2023 grant cycle include, but are not limited to, projects that:

  • Increase the capacity of local municipal partners to scale up their urban forestry program
  • Increase the capacity of all local partners to provide continuous urban forestry finance, services and markets
  • Benefit multiple communities
  • Use existing urban tree inventories

Successful Hunters in the Nebraska Bighorn Sheep Harvest

The Nebraska bighorn sheep hunting season ended Dec. 6 when a hunter from the far east of the state tagged his tag, one of two permits issued for the season.

Todd Nordeen, manager of big game and disease research for the Nebraska Game and Parks Commission that oversees the hunting program, said each of the two rams caught this year was a mature adult with fully curled antlers. Both were harvested in the Wildcat Hills of the Panhandle.

Denton’s Jerry Fischer bagged his ram on a 6-mile hike on December 6, his second day of hunting. He got his permit from a lottery of 3,904 applicants.

The other hunter, Kevin Small, caught his ram on his fourth day of the chase, December 2. He won the permit for it at an auction in February at the annual banquet for the Iowa Chapter of the North American Wild Sheep Foundation.

The sheep mark the 31st and 32nd harvest in Nebraska since the Game and Parks hunting program began in 1998.

The number of Nebraska bighorn sheep permits available each year is based on the state population of the species, especially mature rams, as determined during monitoring by Game and Parks staff. To date, permits have been limited to one or two hunters most years, with several years allowing no harvest at all.

Nebraska has built a reputation for producing trophy-size rams for those lucky enough to get a permit. The hunts not only provide a rare experience and rare table fare, but have been vital to bighorn sheep conservation in Nebraska. About $2 million has been raised through lottery applications and auctions to fund research and reintroduction efforts for the species.

Permit winners are assisted by Game and Parks staff and receive meals and lodging at Fort Robinson State Park.

Bighorn sheep reintroduction efforts in Nebraska began in the 1980s, an attempt to remedy the unregulated hunting, habitat loss, and disease that led to their extirpation from the state in the late 19th century. The Nebraska bighorn sheep population is approximately over 300 rams, ewes, and lambs on both Wildcat Hills and Pine Ridge.

BHA files legal brief in federal court endorsing ‘crossing the corner’

Public access to adjoining public lands via corner crossing is demonstrably legal, BHA maintains

CHEYENNE, Wyoming – Backcountry Hunters & Anglers has filed an amicus brief in a high-profile public access case that the US District Court for Wyoming is expected to hear this summer. The judgment in the case, Iron Bar Holdings v. Bradly Cape et al., could help establish the legality of a means of accessing public land known as “corner crossing,” the act of moving from one corner of a parcel of public land to another, potentially opening up access to millions of acres in 11 states across the West.

Public lands may be inaccessible because they are “landlocked,” surrounded by private lands where there is no right-of-way, public road, or public footpath. In the fall of 2021, four non-resident hunters received citations in Carbon County. Wyoming, for trespassing. The four hunters never touched private land — they used a ladder to cross between adjoining corners of BLM-managed public land.

In its brief, the BHA contends that the plaintiff in this case “cannot secure for itself the value of the public land interspersed with its property by threat of trespass, as the government and its licensees (the public) have the same right to gain access to their lands.

As the basis for its position, the BHA relies on the Illegal Enclosures Act, passed by Congress in the late 1800s to resolve the range wars that broke out between ranchers and farmers over access to and use of land in the West, as well as the cases that interpret that law. The UIA outlines broad prescriptions against the fencing of public land, emphasizing that “no person, by force, threat, intimidation, fencing or enclosure, or any other unlawful means, shall prevent or obstruct…any person from peacefully entering…any public land.” public lands… or impede or obstruct the free passage or transit on or through public lands”.

As early as 1897, the Supreme Court held that the UIA protects corner junctions as a means for members of the public to access public lands. In the years since, federal courts have continued to apply the UIA to prevent private landowners from prohibiting crossing corners from public land onto public land. As an example, in 1988 a Federal Circuit Court held that the “UIA proscribes illegal venues; compounds are illegal when they deny access to public land for ‘lawful purposes.’” That decision upheld a lower court’s finding that “free passage of hunters and their game is a lawful purpose for which the public may seek access to public land.”

Absent the UIA protections, “a barrier would be erected encompassing many thousands of acres of public land, impassable except as prescribed by [landowners]”explained another Circuit Court decision from the turn of the 20th century. “Not even a lone rider could make his way without trespassing,” the court explained, holding that trespassing threats could not be used to prevent corner crossing under the UIA.

The BHA brief also argues that the UIA takes precedence over conflicting state laws. “Federal law, not state law, governs the question of whether private land owners can avoid turning corners,” the BHA brief reads. “The UIA reflects the exercise of Congressional police power to reduce nuisances by landowners who bar access to public lands at street corners, overriding concerns of competing state laws.”

“A landowner with half ownership of one corner has no right to restrict public access by the owner of the other half of the corner, that is, the federal government and, by extension, the people of the United States of America. America,” he said. Land Tawney, president and CEO of the BHA.

Thousands of BHA members and supporters have also pledged their support for corner crossing and the ability for members of the public to legally access US public lands.

Team Federal Shooters Wins Medals in 2022 ISSF President’s Cup
