SAF SUES PENNSYLVANIA SHERIFF TO STOP UNSECURE SEARCHES

BELLEVUE, WA – The Second Amendment Foundation today filed a challenge to the firearm regulation enacted in Pennsylvania and its enforcement by the Pennsylvania State Police and Montgomery County Sheriff’s Office, including warrantless searches judicial.

SAF is joined by Shot Tec, LLC and a private citizen, Grant Schmidt. They are represented by attorneys Joshua Prince and Dillon Harris, Civil Rights Defense Firm, of Bechtelsville, Pennsylvania. The defendants are Colonel Christopher Paris, Commissioner of the Pennsylvania State Police (PSP) and Montgomery County Sheriff Sean Kilkenny in their official duties. The action was filed in the Pennsylvania Commonwealth Court.

The petition challenges Col. Paris and the PSP’s “interpretation, implementation and application” of the firearms regulation “that is being applied” by Kilkenny, according to the court filing. The petition alleges that Sheriff Kilkenny “has implemented a policy … which, according to him, based on the promulgation and implementation of (the regulation) by the PSP, allows him, absent probable cause and a court order and in violation of…the Pennsylvania Constitution, to enter those…homes or businesses.”

The plaintiffs further assert that this inspection allows the sheriff to impose penalties against state firearms license holders “for failing to have ‘secure storage’” in an emergency when the PSP “has not promulgated any regulations that address the what constitutes ‘secure storage’”. ‘ or sufficient guarantees… when the General Assembly only delegated to the PSP the power to establish said standards”.

“The State Assembly has never enacted a law allowing warrantless searches of licensees, but the state police enacted a regulation requiring licensees to submit to such searches, which are now planned by the sheriff’s department,” the director said. SAF executive Adam Kraut. “We believe there are serious constitutional problems involved in this scheme, particularly when an administrative agency simply waives an individual’s constitutional rights by implementing regulation without any framework from the legislature. Equally troubling is the sheriff’s claim that he would revoke an individual’s license who asserts his right to be free from illegal searches and seizures. We have filed this petition to ensure that constitutional rights are respected.”

SAF Founder and Executive Vice President Alan M. Gottlieb observed: “No statute should allow White card regulations that any law enforcement agency must enforce because of the inherent danger of overstepping legal authority and constitutional protections that must be protected in a free society. We are seeking a court remedy to stop this, especially when it comes to warrantless searches.”

The Second Amendment Foundation (www.saf.org) is the nation’s oldest and largest tax-exempt legal action, research, publishing, and education group focusing on the constitutional right and inheritance to own and own guns. fire privately. Founded in 1974, the Foundation has grown to more than 720,000 members and supporters and runs many programs designed to better inform the public about the consequences of gun control.

Federal legislation introduced to mitigate shark predation

The new working group would focus on the complex problem of sharks consuming more and more hooked fish before they can be landed.

On Monday, June 12, 2023, US Representatives Rob Wittman (R-Va.), Darren Soto (D-Fla.), Garret Graves (R-La.) and Marc Veasey (D-Tex.) hosted the Supporting program the Health of aquatic systems through the Research, Knowledge and Enhanced Dialogue (SHARKED) Act in the US House of Representatives. Legislation will begin to address the growing challenge of shark predation, which occurs when a shark eats or damages a hooked fish before an angler can catch a fish.

In general, the possibility of predation occurring is accepted as a natural part of fishing. However, in recent years the frequency of shark predation has increased rapidly in many parts of the country, especially along the Atlantic coast, the southeastern United States, and the western Pacific. The causes are generally recognized to be increased fishing activity, increased abundance of sharks, and predation, which more often becomes a learned behavior.

If enacted, the bill would establish a working group comprised of fisheries managers and shark experts responsible for improving coordination and communication in the fisheries management community on shark predation and identifying research priorities and funding opportunities. . The bill would be the first step towards mitigating shark predation at the national level and creating fundamental knowledge that can be used to improve future management, education and research actions.

“Sharks are a vital part of our ocean ecosystems, but in many parts of the country shark predation is becoming a growing problem that is not just inconvenient, but completely disrupting fishing,” he said. ASA Vice President of Government Affairs Mike Leonard. “These conflicts are bad for the fish, the fishermen and the sharks. This is a complex and multifaceted challenge that requires a dedicated task force to bring attention to the issue.”

“As a lifelong fisherman, I have experienced firsthand the impacts of shark predation and witnessed its effect on our marine ecosystem.” said Congressman Wittman. “I introduced the SHARKED Act to improve the environment for our marine life and sport fishing conditions for anglers while protecting sharks from unsafe conditions and food sources. The SHARKED Act will also serve as the first major step in addressing shark predation across the country. I am proud that my colleagues on both sides of the aisle are joining me in this important effort and leading the way in restoring our marine ecosystem and improving fishing experiences for anglers.”

“We must act now to help recreational fishermen and commercial fishermen in Florida and the US who are reporting an increase in shark predation, a phenomenon that negatively impacts fishing experiences, threatens shark safety, and humans and damages the sustainability of target fish stocks. ,” said Congressman Soto. “That’s why I’m proud to co-file the Supporting Aquatic Systems Health Through Research Insights and Enhanced Dialogue (SHARKED) Act, a bill that will direct the Department of Commerce to establish a group to combat shark predation and assist Florida fishermen while protecting the future of the fishing industry and our marine ecosystems.”

Quality Habitat Means Abundance of Birds in South Dakota

PIERRE, SD – South Dakota Game, Fish and Parks (GFP) today announced the total pheasant harvest for the 2022-2023 season. The traditional season ran from October 15, 2022 to January 31, 2023. During this season, hunters caught approximately 1,158,000 birds.

“South Dakota is the best state in the country for pheasant hunting,” said Kevin Robling, GFP secretary. “The harvest numbers show exactly why – hunters will find abundant birds across the state all season long.”

Hunter reports throughout the 2022 season spoke of this abundance of birds, and harvest numbers back up their claims. The 2022 season saw the highest crop since 2016 and was 10% higher than the average of the last 10 years. These numbers translate to excellent bags for hunters, averaging 9 pheasants per hunter for the 2022 season.

South Dakota’s claim to be the top pheasant hunting state is supported by these pheasant per hunter numbers. While surrounding states typically see take rates of 3-6 birds per hunter, South Dakota has take rates of around 9 pheasants per hunter, as of 2022.

South Dakota’s focus on habitat and public access has resulted in large numbers of birds throughout the state, wide areas to attack them, and generally good hunting conditions.

“Habitat quality is key to abundant wildlife populations, which is why this is the number one priority for our department,” Robling continued. “Hunters also need to have access to these areas in order to enjoy these populations.”

GFP has 12 private land habitat biologists who work directly with landowners to identify habitat projects and access programs that will benefit landowners, hunters, and wildlife. Working alongside landowners and in the state’s game production areas, GFP focuses on planting and improving all types of habitat, including perennial grasses, woody vegetation, and pollinator patches throughout the state.

Providing access to these areas for hunters to enjoy is critical. As of 2022, there were 1.48 million acres of private land enrolled in GFP’s public access programs. These lands are enrolled in the GFP Walk-In Area, James River Basin Conservation Preserve Enhancement Program (CREP), Hunting Controlled Access Program, Waterfowl Access Area Lower Oahe, Moose Access Area, and Water Access programs.

“Our largest program for access to private land is our Walk-In Area program,” said Mark Norton, Hunting Access and Farm Bill coordinator. “This year we celebrate its 35he anniversary and we look forward to continuing to build on one of the most successful programs in history for public access to hunting.”

Approximately 80% of the land in South Dakota is privately owned, making these access programs critical to extensive public hunting opportunities. The various programs are tailored to the different hunting opportunities throughout the state and the various needs of the owners themselves.

“Our most popular programs for pheasant hunting are the CREP programs, both in the James River Basin and now in the Big Sioux River Basin, and of course the Walk-In Area Program as well,” Norton continued.

The purchase of both hunting and fishing licenses, as well as the habitat stamp, directly supports these programs.

“The best investment a hunter can make is the purchase of his license,” Robling said. “Conservation is a user-paid public benefit system, and the habitat stamp in particular is a perfect example of this.”

After celebrating another successful pheasant season, GFP is focusing on the upcoming season. Habitat improvement projects take place throughout the spring and summer, and biologists continue to contact landowners to enroll their land in public hunting programs. GFP’s goal for 2023 is to surpass 1.5 million acres of private land registered for public hunting, up from 1.48 million registered acres in 2022. Hunters will be able to enjoy the results of these efforts when the next season.

“Our pheasant hunting traditions are strong in South Dakota,” Robling concluded. “We are going to continue to develop these traditions and ensure that the next generation can enjoy the same success in pheasant hunting that we enjoy today.”

The 2023 traditional pheasant season runs from October 21, 2023 to January 31, 2024.

New OSCF Research Shows Decline in General Population Support for Fishing, Target Shooting and Hunting

Middlebury, CT – A comprehensive research study conducted by the Responsive Management for Outdoor Stewards of Conservation Foundation (OSCF) sought information on the current attitudes of American adults toward fishing, shooting, hunting, and trapping.

The project was a continuation of similar studies conducted by Responsive Management and provides trend data dating back to 1995. As the oldest study of American attitudes toward these activities, it is a useful tool for understanding both historical trends and the current feelings of Americans.

The report’s results paint an ominous picture for those who work in the outdoor industry. General population support for fishing, target shooting, and hunting has declined since the last time the study was conducted. For example, approval for both legal recreational fishing and recreational target shooting decreased by three percent (3%), while approval for legal hunting decreased by four percent (4%).

“The percentages may seem small at first glance, but this study is representative of 253 million adult Americans (ages 18 and older), so four percentage points equals more than 10.1 million Americans,” said Mark Damian Duda. , who has been the Executive Director of Responsive Management since 1985. Mark continued: “The findings are concerning, but having this knowledge will enable the industry to make changes to stop or reverse the loss of support. The most important thing we can do next is learn the specific reasons why Americans no longer approve of these activities at the rate they used to.”

Outdoor Stewards of Conservation Foundation Vice President Jenifer Wisniewski, who is also director of marketing for the Tennessee Wildlife Resources Agency (TWRA), said of the findings: “It was a shock to see a loss of support on a large scale , but it certainly acts as a wake-up call for the entire outdoor industry to do better. For our part, TWRA has been working more closely with industry partners to promote the positive contributions of men and women in the air. With the release of this report, I believe this should not only continue, but should be expanded across the country.”

The research project was funded through a Multi-State Conservation Grant administered through the USFWS and the Association of Fish and Wildlife Agencies. Comprehensive and top-of-the-line reports entitled “American attitudes toward legal and regulated fishing, target/sport shooting, hunting, and fishingthey are available, free of charge, at https://www.outdoorstewards.org/americans-attitudes-towards-fishing-target-shooting-hunting-and-trapping/.
